Title: Prohibits Possession of Certain Flamethrowers

  • Specifies that an individual in criminal possession of a flamethrower shall be classified as a class E felony (Sec. 1).

  • Exempts historical flamethrowers used for agricultural or construction purposes, or any flamethrower lawfully acquired and possessed prior to the effective date of this act (Sec. 1).

  • Defines “flamethrower” as a device capable of projecting a stream of burning fuel at a distance of at least 3 feet and specifies inoperable display units shall not be considered the same for the purposes of this act (Sec. 1).

  • Defines “historical flamethrower” as a flamethrower constructed in whole or in substantial part, of components manufactured prior to 1966 (Sec. 1).

  • Defines “significant components” as fully functional and necessary parts for the operation of a flamethrower, including, but not limited to (Sec. 1):

    • Fuel cells, gas caps, or pressure regulators;

    • Pressure regulators, pressure bottles, or hoses;

    • Wand fuel valves, barrels, or front grips; and

    • Ignition shield and rear grips.
