    • A person who served in the executive branch of the government of the United States on the executive staff of the President, in the executive office of the President, or in an acting or confirmed capacity in a position subject to confirmation from the U.S. Senate when the President pardoning them is the one they worked for;

    • A person who directly or indirectly was employed by, or acted as an agent of the election, transition, or re-election campaign of the President granting the pardon or clemency;

    • Any entity owned or controlled by the President that is granting the pardon or clemency;

    • A person related to the President granting the pardon, whether it is by blood or through marriage to the 6th degree;

    • The person granted the pardon bears accessorial liability or conspiratorial liability to one or more people meeting any of the above conditions;

    • The president who granted the pardon or clemency was aided by avoiding potential prosecution or conviction, or knowingly obtained a benefit “from such offense”, or a tangible material benefit from or behalf of such person; or

    • The person has or had information material to the determination of any criminal or civil investigation, enforcement action, or prosecution of the president granting such pardon or clemency.
