Vote to concur with house amendments and pass a bill that amends criminal sentencing laws, effective November 1, 2019.

Highlights:

• Authorizes a court to resentence an individual, either by trial or plea, that has been sentenced to a crime that would, as of July 1, 2017 been found guilty as a misdemeanor (Sec. 1).

• Prohibits a hearing from being conducted to modify a sentence unless requested by the individual (Sec. 1).

• Requires that a individual whose sentence is modified be given credit for time served (Sec. 1).

• Requires that any individual be considered for an accelerated deferred judgement for an offense where the penalty has been subsequently been lowered from a felony to a misdemeanor (Sec. 4).

• Authorizes the Pardon and Parole Board to establish an accelerated single-stage commutation docket for any individual convicted of a crime that has been reclassified from a felony to a misdemeanor (Sec. 5).

• Specifies that if a court determines that an applicant is entitled to have his or her conviction reclassified as a misdemeanor then the conviction shall be considered a misdemeanor for all purposes (Sec. 7).
