Highlights:

  • Prohibits a local governments from adopting or enforcing a resolution, policy, or regulation that does the following, including (Sec. 1):

    • Regulates the use, disposition, or sale of an auxiliary container;

    • Prohibits or restricting an auxiliary container; or

    • Enacts a fee, charge, or tax on an auxiliary container.

  • Defines “auxiliary container” as a bag, cup, bottle, can, device, eating or drinking utensil or tool, or other packaging whether reusable or single use, which is (Sec. 1):

    • Made of cloth, paper, or plastic, including foamed or expanded plastic, cardboard, corrugated material, aluminium, glass, post-consumer recycled material; and

    • Designed for transporting, consuming, or protecting merchandise, food, or beverages at a food service, retail, or manufacturing facility.

  • Prohibits this act from restricting the following, including, but not limited to (Sec. 1):

    • A curbside recycling program;

    • A designated residential or commercial recycling location and program;

    • The use of an auxiliary container on a property owned by a local government; or

    • The regulation of auxiliary containers at events, concerts, or sporting events owned by a private or public entity or managed by a local government.
