Title: Repeals Pseudoephedrine and Ephedrine as Class 3 Controlled Substances

  • Authorizes a pharmacist or pharmacy technician to transfer a drug containing pseudoephedrine or ephedrine, or a salt, isomer, or salt of an isomer of pseudoephedrine or ephedrine without a prescription from a practitioner to a person over the age of 18 and who provides a valid form of photo identification (Sec. 2).

  • Requires a pharmacist or pharmacy technician submit the following information prior to the drug transfer including (Sec. 2):

    • The date and time of the transfer;

    • The name, address, date of birth of the person that will be receiving the transfer;

    • The form of government-issued photo ID and identification number of the person receiving the transfer;

    • The name of the government agency that issued the photo identification; and

    • The name and amount of the drug that will be transferred.

  • Requires that drugs described under this act be transferred from behind a pharmacy counter and in an area that is closed to the public (Sec. 2).
