Title: Prohibits Smoking Under the Age of 21

Vote to pass a bill that prohibits smoking under the age of 21.

Highlights:

 

  • Defines “tobacco product” as a product made from or derived from tobacco that contains nicotine for human consumption by smoking, heating, chewing, dissolving, inhaling, or ingesting, including but not limited to the following (Sec. 1):

    • Cigarettes;

    • Cigars;

    • Hookah tobacco;

    • Chewing tobacco;

    • Snuff;

    • Snus; and

    • Smokeless tobacco.

  • Specifies that “tobacco product” includes components or accessories used in the consumption of a tobacco product, including filters, rolling papers, and pipes (Sec. 1).

  • Specifies that “tobacco product” does not include a drug, device, or combination product that has been authorized for  sale by the Food and Drug Administration under the federal Food, Drug, and Cosmetics Act (Sec. 1).

  • Defines “tobacco substitute” as an electronic smoking device that uses a mechanical heating element, battery, or circuit to produce aerosol or vapor for inhalation into the body (Sec. 1).

  • Specifies that “tobacco substitute” includes the liquid used in a an electronic smoking devices (Sec. 1).

  • Specifies that “tobacco substitute” does not include a drug, device, or combination product authorized for  sale by the Food and Drug Administration under the federal Food, Drug, and Cosmetics Act (Sec. 1).

  • Requires sellers of tobacco products to check the proof of age of any purchaser under the age of 30 (Sec. 3).

  • Specifies that anyone found guilty of violating this Act will be fined $25 for the first offense, $500 for the second offense, and $1,000 for the third and all subsequent offenses (Sec. 6).

  • Requires employers of a vapor establishment to provide the following information to the Division of Alcohol and Tobacco Enforcement, for employees they wish to continue to employ who are under the age of 21 (Sec. 11):

    • The employee's name;

    • The employee’s date of birth;

    • The employer's name; and

    • Proof that the employee was employed by the vapor establishment on the effective date of this Act by providing a pay stub, an IRS W-2 tax form, a state UC-8A quarterly report, or other documentation of monetary pay to the employee.
