Title: Prohibits Single-Use Plastic Bags

Vote to pass a bill that prohibits single-use plastic bags by stores and food service businesses, effective 6 months after bill's passage.

Highlights:

 

  • Prohibits stores and food service businesses from providing a single-use plastic carryout bag to a customer after a sale (Sec. 2).

  • Specifies that a store or food service business may charge $00.10 to customers for a single-use plastic bag in the 4 months following the bills passage (Sec. 2).

  • Exempts Supplemental Nutritional Assistance Programs (SNAP), Electronic Benefit Transfer (EBT), and Woman, Infants, and Children (WIC) programs from these provisions (Sec. 2).

  • Exempts the following from these provisions, including, but not limited to (Sec. 2):

    • Handless paper bags 6 inches across or less; or

    • Bags used for which there are not reasonable packaging or distribution alternative.

  • Defines “store” as any retail establishment that sells or provides merchandise, goods, or materials directly to a customer, including, but not limited to (Sec. 2):

    • Restaurants, grocery stores, or supermarkets;

    • Convenience stores, liquor stores or drug stores; and

    • Pharmacies or other retail establishments.

  • Defines “food service business” as a business that sells or provides food for consumption on or off the premises and includes the following (Sec. 2):

    • Restaurants, cafes, or coffee shops;

    • Supermarkets, grocery stores, or delicatessen (deli); and

    • Vending truck or cart, food truck, movie theater, or institutional cafeteria.

  • Defines “single-use carryout bag” as a bag made of plastic, paper, or other material that is provided by a store or food service business to a customer at the point of sale (Sec. 2).
