Title: Authorizes Sale of Recreational Marijuana
Vote to pass a bill that authorizes the sale of recreational marijuana to individuals 21 years or older, effective July 1, 2019.
Authorizes the possession of no more than one ounce of marijuana and eight grams of marijuana extract (Sec. 25).
Specifies that the penalty for those under 21 years old found in possession of marijuana are subject to a $75 fine (Sec. 29).
Establishes a “cannabis control commission” to oversee marijuana regulation (Sec. 3).
Requires sales of marijuana to become taxable and referred to as the “cannabis excise tax” (Sec. 43).
Requires the Departmentment of Health to establish a medical marijuana subsidy program which will distribute portions of the marijuana excise tax revenue to provide medical marijuana to sick and indigent individuals (Sec. 4).
Establishes the “road safety fund” which will consist of money transferred from the cannabis excise tax to the Department of Public Safety (Sec. 40).
Requires the department to research whether marijuana usage impairs a driver’s ability to operate a vehicle and provide research to law enforcement officers for roadside impairments tests (Sec. 53).
Requires the department to identity requirement for the licensure of qualified patients to produce marijuana for medical use (Sec. 57).
