Title: Amends Criminal Justice Regulations

Vote to pass a bill that amends criminal justice regulations, effective July 1, 2019.

Highlights:

 

  • Authorizes drug intervention courts to provide clinical assessments for individuals who have two or more DUI convictions to determine whether they have an alcohol dependence (Sec. 8).

  • Authorizes drug intervention courts to recommend and provide court-approved medication-assisted rehabilitation treatment (Sec. 8).

  • Authorizes individuals convicted of a felony to apply for one-time expungement of public records which show prior criminal convictions, but does not apply to the following convictions (Sec. 41):

    • Violent crimes;

    • First degree arson;

    • Trafficking of controlled substances;

    • Third, fourt, and subsequent DUI offences;

    • A felon found possession of a firearm;

    • Failure to register as a sex offender;

    • Voyeurism; and

    • Witness intimidation.
