Vote to pass a bill that establishes net neutrality regulations.

Highlights:

 

  • Prohibits an internet service provider (ISP) from receiving money through a grant from the Broadband Deployment Board or through any state fund if the ISP (Sec. 1):

    • Blocks any lawful internet content, applications, services, or devices unless the blocking is conducted in a manner consistent with reasonable network management practices;

    • Engages in paid prioritization of internet content;

    • Regulates network traffic by throttling bandwidth or otherwise impairs or degrades lawful internet traffic on the basis of internet content, application, service, or use of non harmful device unless the impairment or degradation results soley from the evenhanded application or reasonable network management; or

    • Fails or refuses to disclose its network management practices.

  • Requires ISPs to fully refund any money that the ISP received in the 24 months preceding the board’s determination from the high cost support mechanism pursuant to a grant awarded by the board (Sec. 1).

  • Exempts ISPs from the obligations of this act if it engages in any of the practices listed in this act in the course of (Sec. 2):

    • Providing, facilitating the provision of, or addressing emergency communications, as permitted or required by law or at the request or direction of authorities serving in law enforcement, public safety, or national security; or

    • Addressing copyright infringement or other unlawful activity.

  • Requires a governmental body, when contracting for broadband internet access service, to give preference to an ISP that certifies to the governmental body that, except under the exemptions, he ISP will not engage in any of the practices set forth by this act (Sec. 4).
