Vote to pass a bill that reduces criminal penalties for marijuana possession, effective July 1, 2019.

Highlights:

 

  • Requires an individual who violates the prohibition of the possession of marijuana by up to one-half ounce of marijuana to be issued a penalty assessment and is subject to a fine of $50 (Sec. 1).

  • Requires an individual who violates the prohibition of the possession of marijuana by more than one-half ounce but less than one ounce of marijuana is, for the first offense, to be guilty of a petty misdemeanor and will be fined not less than $50 or more than $100 and by imprisonment for no more than 15 days (Sec. 1).

  • Requires an individual who violates the prohibition of the possession of marijuana by more than one-half ounce but less than one ounce of marijuana is, for the second or subsequent offense, to be guilty of a misdemeanor and will be fined not less than $100 or more than $1000, or by imprisonment for a definite term of less than one year, or both (Sec. 1).

  • Requires an individual who violates the prohibition of the possession of marijuana by more than one ounce but less than eight ounces of marijuana to be guilty of a misdemeanor and will be fined not less than $100 or more than $1000, or by imprisonment for a definite term of less than one year, or both (Sec. 1).

  • Requires an individual who violates the prohibition of the possession of marijuana by eight ounces or more of marijuana to be guilty of a fourth degree felony and will be sentenced to of 18 months imprisonment, a $5000 fine, or both (Sec. 1).
