Title: Requires Lifesaving Measures After Failed Abortion
A vote to pass a bill that requires medical personnel to rescue viable fetuses if they survive an abortion.
Requires that a physician performing an abortion attempt to revive a fetus if it shows any signs of life including (Sec. 1-3):
Breathing;
A heartbeat;
Umbilical cord pulsation; or
Definitive movement of voluntary muscles.
Specifies that the occurrence of this event in a hospital requires immediate medical care, informing the mother of the live birth, and a request for transfer to the on-duty resident or emergency physician (Sec. 3).
Specifies that the occurrence of this event in any medical facility other than a hospital requires immediate medical care and a 911 call for an emergency transfer to a hospital (Sec. 3).
Specifies that failure to comply could result in (Sec. 4):
Civil action for compensatory or punitive damages;
Professional disciplinary action for the suspension or revocation of licensure; and
A wrongful death claim.
