Title: Authorizes Online Sports Gambling

Highlights:

 

  • Authorizes the commission to regulate interactive wagering and the conduct of interactive gaming under this act (Article 22E, Sec. 29-4).

  • Defines “Commission” as the West Virginia State Lottery Commission (Article 22E, Sec. 29-3).

  • Establishes the following types of betting as legal “interactive wagering or gaming” including, but not limited to (Article 22E, Sec. 29-3):

    • Pari-mutuel betting on horse or dog races;

    • Lottery games played in the West Virginia Lottery;

    • Racetrack or limited video lottery;

    • Racetrack table games; and

    • Sports Wagering or daily fantasy sports.

  • Specifies that the commission may implement the following types of rules regarding interactive wagering or gaming, including, but not limited to (Article 22E, Sec. 29-4):

    • The acceptance of wagers on interactive games;

    • Maximum wagers which may be accepted by an operator;

    • Methods of accounting used by operators;

    • Use of credit and checks by patrons; and

    • Protections for patrons placing wagers and the promotion of social responsibility.

  • Authorizes the commission to determine the eligibility of a person to hold or continue to hold a license, issue all licenses, accept applications, evaluate qualifications, undertake initial review, and maintain a record of all licenses issued under this act (Article 22E, Sec. 29-4).

  • Defines “license” as any permit license issued by the commission under this act, including, but not limited to (Article 22E, Sec. 29-3):

    • A license to act as an agent of the commission in operating interactive wagering at a licensed gaming facility;

    • A license to supply a gaming facility with interactive wagering equipment or services necessary for the operation; or

    • A license to be employed

  • Authorizes the Commission to levy and collect all fees, surcharges, civil penalties, and weekly tax on adjusted gross interactive wagering receipts imposed by this article (Article 22E, Sec. 29-3).

  • Prohibits any individual from engaging in any activity in connection with West Virginia Lottery interactive wagering in this state unless all necessary licenses have been obtained in accordance with this act (Article 22E, Sec. 29-5).
