A vote to pass a bill that prohibits the abortion of an unborn child on the basis of their gender, race, or disability.

Highlights:

 

  • Prohibits all abortions procedures based on sex, race, national origin, or disability diagnoses (Sec. 1).

  • Specifies that disability does not include lethal fetal anomalies and defines “disabilities” as the following, including, but is not limited to (Sec. 1):

    • Physical, mental, or intellectual disabilities;

    • Physical disfigurement, or a physical or mental disease; and

    • Albinism, dwarfism, or scoliosis.

  • Excludes abortions in cases of medical emergencies (Sec. 1).

  • Requires physicians to certify in writing whether they had any knowledge the individual seeking the abortion was doing so due to any specified restricted reasoning  (Sec. 1).

  • Authorizes the State Board of Medical Licensure to revoke a physician’s medical license following  violation of this bill (Sec. 1).

  • Authorizes the Cabinet for Health and Family Services to revoke the medical licenses of abortion facilities that fail to comply with this bill (Sec. 1).

  • Specifies that any physicians or individuals who fail to comply with this bill are liable to civil action for compensation and punitive damages to the unborn fetus (Sec. 1).  

  • Classifies any violation of this bill as a Class D felony (Sec. 4).
