  • Classifies the crime of breaking and entering the dwelling of another person at which there is no person currently present with intent to steal any property as second-degree burglary (Sec. 1). 

  • Classifies the crime of breaking and entering an automobile, truck, trailer, or vessel of another, with intent to steal any property, as third-degree burglary (Sec. 1).

  • Repeals the mandatory minimum of 2 years of imprisonment for second-degree burglary (Sec. 2).  

  • Establishes a punishment of up to 5 years of imprisonment for third-degree burglary (Sec. 2).
