Highlights:

 

  • Authorizes all fly ash produced by coal combustion generating facilities to be exempt from all solid waste, as long as such ash is reused or disposed of by a grouting technique (Sec. 1).

  • Requires the reuse to take place in any active or inactive noncoal, non-open-pit mining operation located in a city having a population of at least 350,000 (Sec. 1).

  • Authorizes that the Department of Natural Resources can make rules for the management, closure, and post-closure of coal combustion residual (CCR) units (Sec. 1).

  • Authorizes the Department of Natural Resources authority to assess one-time enrollment and annual fees on owners of CCR units (Sec. 1).

  • Authorizes that all fees shall be paid by check or money order to the Department of Natural Resources and shall be due on January 1 of each calendar year (Sec. 1).

  • Requires that all fees must be deposited into the “Coal Combustion Residuals Subaccount” and shall be dedicated to the department for conducting activities related to the state CCR program (Sec. 1).
