Vote Smart's Synopsis:

Vote to concur with senate amendments and pass a bill that requires coverage of egg and sperm preservation.

Highlights:

  • Specifies that voluntary male sterilization procedures are not covered to the extent that such coverage would disqualify a high-deductible health plan from eligibility for a health savings account pursuant to the federal Internal Revenue Code, 26 U.S.C. 223 (Sec.  356).

  • Defines “iatrogenic infertility” as the impairment of fertility by surgery, radiation, chemotherapy, or other medical treatment affecting reproductive organs or processes (Sec. 356).

  • Defines “standard fertility preservation services” as procedures based upon current evidence-based standards of care established by the American Society for Reproductive Medicine, the American Society of Clinical Oncology, or other national medical associations that follow current evidence-based standards of care (Sec. 356).

  • Requires an individual or group policy of accident and health insurance that is amended, delivered, issued, or renewed in this state after the effective date of this act, to give coverage for medically necessary expenses for standard fertility preservation services when a necessary medical treatment will likely directly or indirectly cause iatrogenic infertility to the individual (Sec 356).

  • Prohibits insurers from discriminating against an individual’s expected length of life, present or predicted disability, degree of medical dependency, quality of life, health conditions, or personal characteristics, including age, sex, sexual orientation, or marital status (Sec. 356).
