  • Prohibits law enforcement agencies from publishing booking photographs on its social media website (Sec. 5).

  • Specifies that this applies to civil, petty, and business offenses, as well as Class C and B misdemeanors (Sec. 5).

  • Authorizes use of photographs on social media in order to assist in the search of missing persons, fugitives, persons of interest, or individuals wanted for types of crimes other than the ones listed above (Sec. 5).

  • Requires entities that publish criminal records for profit to correct any errors about an individual within 5 days of notification. Failure to do so will constitute an unlawful and deceptive practice. Exempts (Sec. 10): 

    • Plays, books, magazines, newspapers, musicals, compositions, radio, movies, television, or any other work of art;

    • The Illinois State Police; and

    • Consumer reporting agencies.
