Title: Increases OWI Penalties

Vote to pass a bill that increases penalties for individuals convicted of repeat OWI offenses.

Highlights:

 

  • Requires an individual convicted of their second OWI offense pay a fine of $1,000 and be sentenced to at least 90 days in jail and an individual convicted of their third OWI arrest pay a fine of $2,500 and sentenced to 6 months in jail (Sec. 1).

  • Increases the prison term for an individual convicted of an OWI resulting in death from 3 years to 5 years and authorizes a prison term of 7 years for individual guilty of 2 or more prior OWI convictions and is charged with an OWI resulting in death (Sec. 1).

  • Specifies that an individual convicted of causing death as a result of an OWI shall be convicted of a second degree felony and be required to serve each year of their sentence consecutively imposed for each victim death (Sec. 1).

  • Specifies that an individual refusing to a breath or chemical drug test pursuant to a valid search warrant or court order will have committed a third degree felony (Sec. 3).
