Title: Protecting Against Child Exploitation Act of 2017

Vote to pass a bill that prohibits producing or knowingly transmitting a visual depiction of a minor engaged in sexually explicit conduct.

Highlights:

  • Specifies that it is a federal crime to do any of the following (Sec. 2):

    • Knowingly produce or cause to be produced a visual depiction of a minor engaged in sexually explicit conduct;

    • Knowingly transmit a live depiction of a minor engaged in sexually explicit conduct;

    • Have a minor assist another individual in producing or transmitting a depiction of sexually explicit conduct; or

    • Allow a minor under one's custody to engage in sexually explicit conduct, whether present or away, and knowing that such conduct is going to be captured and transmitted.

  • Prohibits bringing a criminal charge against an internet service provider (ISP) for violations that occur through their network or service, unless it is the ISP itself that knowingly produces or transmits the sexually explicit material in question (Sec. 2).

  • Specifies that a civil claim or criminal charge against an ISP or domain name register arising from the response to a search warrant or other legal process related to sexual exploitation or child abuse may not be brought in any federal or state court (Sec. 3).
