Authorizes Judges to sentence individuals that were convicted of non-sexual, nonviolent, fourth- and fifth-degree felonies to "community control" facilities.

Highlights:

  • Authorizes an eligible offender convicted of committing any of the following acts to enter into a pretrial diversion program, including, but not limited to (Sec. 2935.36):
    • A misdemeanor; and

    • A fourth or fifth degree felony.

  • Defines “Eligible offender” as an individual who has been convicted of 1 or more non sexual misdemeanor offenses and no more than 5 fourth or fifth degree felonies in this state or any other jurisdiction (Sec. 2953.31).

  • Authorizes a judge to sentence eligible offenders convicted of non-sexual, nonviolent, fourth or fifth degree felonies to a "community control" facility which includes a correctional facility or halfway house (Sec. 2929.15).
