Title: Prohibits Sanctuary Cities

Vote to pass a bill that requires local government to comply with a detainer request issued by a federal law enforcement agency, effectively prohibiting what is commonly referred to as a sanctuary city.

Highlights:

  • Prohibits a local government from interfering with either of the following (Sec. 2):
    • A detainer request issued by a federal law enforcement agency; or

    • The ability of a federal law enforcement official to enter and conduct enforcement activities at a municipal or county jail.

  • Exempts certain cases involving victims of, or witnesses to, a crime, children attending school and individuals utilizing services of a municipal hospital (Sec. 2).

  • Requires the commissioner, in conjunction with the superintendent of the state police, to keep an updated list of local governments and entities that are in violation (Sec. 1).

  • Specifies that for purposes of this bill, a “federal law enforcement agency” includes (Sec. 2):

    • The Central Intelligence Agency;

    • Department of Homeland Security;

    • Drug Enforcement Agency;

    • Federal Bureau of Investigation;

    • Immigration and Customs Enforcement;

    • National Park Service;

    • Secret Service;

    • Transportation Security Administration;

    • Customs and Border Protection; and

    • United States Coast Guard.

  • Specifies that this bill takes effect immediately upon the Governor’s signature (Sec. 4).
