Title: Limits Punitive Damages in Certain Medical Lawsuits
Vote to pass a bill that limits the amount of punitive damages that may be awarded in certain medical lawsuits.
Prohibits punitive damages that exceed 250 percent of compensatory damages awarded in lawsuits against the following types of defendants (Sec. 1):
Assisted living residences;
Long-term nursing care facilities; or
An employee or officer of either of the above types of facilities.
Specifies that the above limitation does not apply in the following circumstances (Sec. 1):
The plaintiff is a veteran;
The plaintiff is an unemancipated minor;
The plaintiff has been diagnosed with post-traumatic stress disorder;
The plaintiff has an intellectual disability; or
The court finds that the defendant acted with intent to harm, falsified medical records related to the case, or has been convicted of a crime related to the case.
