Title: Increasing Access to Lower Premium Plans and Expanding Health Savings Accounts Act of 2018

Vote to pass a bill that amends the Internal Revenue Code of 1986 and the Patient Protection and Affordable Care Act to modify the definition of qualified health plans.

Highlights:

 

  • Amends the Internal Revenue Code of 1986 to define that the Patient Protection and Affordable Care Act shall not include any health plan that qualifies as any of the following, including, but not limited to (Sec. 1):

    • Grandfathered or grandmothered health plan; or

    • Any health plan that covers abortion unless necessary for safety concerns of the mother or in cases of rape or incest.

  • Defines a grandmothered or grandfathered health plan as health insurance coverage which is offered in the individual health insurance market beginning October 1, 2013 as a result of CCIIO guidance (Sec. 1).

  • Defines “CCIIO guidance” as a letter issued by the Centers for Medicare and Medicaid Services to the State Insurance Commissioners outlining a transitional policy for grandfathered coverage in the individual health insurance market (Sec. 1)

  • Defines “individual health insurance market” as the market for health insurance offered to individuals other than in connection with a group health plan (Sec. 1).

  • Specifies that nothing in this act will prohibit an individual from purchasing separate coverage for abortions, or a health plan that includes abortion so long as none of the credits made available under this act go towards providing abortion coverage (Sec. 1).

  • Specifies that any infection, injury, disease, or disorder caused or exacerbated by an abortion procedure will not be treated or classified as such for the purposes of this act (Sec. 1).

  • Establishes that this act will go into effect beginning December 31, 2018 (Sec. 1).
