Vote to pass a bill that prohibits the creation, distribution, or possession of sexually explicit digital material that depicts a minor, commonly referred to as "sexting".

Highlights:

• Prohibits an individual under the age of 19 from creating, distributing, or possessing sexually explicit digital material that depicts a minor through a telecommunications device (Sec. 1).

• Authorizes exceptions to the prohibition above if the minor depicted is the individual’s self, spouse, or child, or the child of another if the material is possessed or distributed for certain lawful purposes (Sec. 1).

• Classifies the possession or distribution of sexually explicit digital material by a minor as a first-degree misdemeanor subject to 8 hours of community service (Sec. 1).

• Authorizes an affirmative defense for minors who receive sexually explicit digital material so long as they don’t solicit or share it and delete it upon receipt (Sec. 1).

• Requires courts to offer a sexting educational diversion program for first-time offenders (Sec. 1).

• Authorizes dismissal of charges for minors who successfully complete the diversion program (Sec. 1).
