Title: Authorizes Expunged Convictions for Victims of Human Trafficking
Vote to pass a bill that authorizes courts to expunge a criminal record related to an offense that resulted from being a victim of human trafficking.
Authorizes individuals convicted of certain prostitution-related offenses to apply for the expungement of records related to the offenses if they committed the offenses because they were a victim of human trafficking (Sec. 1).
Exempts a conviction of murder or rape (Sec. 1).
Authorizes a victim of human trafficking who is found not guilty of an offense or who is the defendant named in a dismissed criminal charge to apply for a court order to expunge the individual’s records in the case (Sec. 1).
Requires, as a condition of granting the expungement, that the court find that the victim’s interest in having the records expunged is not outweighed by government’s need to maintain such records (Sec. 1).
Authorizes intervention in lieu of conviction (ILC) for individuals charged with committing an offense while being a victim of compelled prostitution (Sec. 1).
