Vote Smart's Synopsis:

Vote to pass a bill that amends various public safety laws, including laws relating to sexual conduct and law enforcement.

Highlights:

• Prohibits police officers from having sexual contact, exposing intimate body parts, or engaging in other forms of lewd behavior while an individual is in their custody (Article 5, Secs. 7 & 9). 
• Specifies that consent of the individual in custody is not a defense (Article 5, Sec. 9). 
• Removes a provision that excluded the touching of an individual’s clothed buttocks from the definition of "sexual contact" (Article 5, Sec. 13).  
• Specifies that the above provisions do not apply to “any penetration of the mouth, genitals, or​ anus during a lawful search" (Article 5, Sec. 7). 
• Increases the penalty for assaulting a police officer without inflicting bodily harm from a gross misdemeanor to a felony punishable by up to 2 years in prison, a fine of not more than $4,000, or both (Article 4, Sec. 7). 
• Prohibits local officials from disarming police officers in good standing and not currently under investigation or subject to disciplinary action (Article 3, Sec. 18). 
• Specifies that harassing conduct or communication does not have to be severe or pervasive to qualify as discriminatory sexual harassment (Article 2, Sec. 7). 
• Requires the consent of any defendant or victim before any individual can record or broadcast a criminal matter (Article 2, Sec. 15).
• Amends the definition of criminal vehicular homicide to include driving in a reckless manner while texting and causing either of the following (Article 4, Secs. 4-6):
• Harm or death of a pregnant individual’s fetus; or
• Great bodily harm to another.
• Establishes a mandatory minimum sentence of 6 months in jail for first-time offenders convicted of distribution and possession of child pornography (Article 5, Sec. 27).
