Vote to pass a bill that prohibits students convicted of criminal sexual conduct from attending the same school as the victim.

Highlights:

 

  • Authorizes the school board, superintendent, school principal, or another school district official to order the suspension or expulsion of a student who commits criminal sexual conduct against another student enrolled in the same school district (Sec. 1311).

  • Specifies that a student expelled under this act is still eligible to complete alternative education programs such as online cyber school (Sec. 1311).

  • Authorizes a student found to of possessed a dangerous weapon in a weapon free school zone be expelled from the school district, but specifies that the student does not have to be expelled if any of the following is established as being true, including, but not limited to (Sec. 1311):

    • The weapon was possessed by the student at the request or direction of school or police authorities;

    • The weapon was not knowingly possessed by the student;

    • The student did not have knowledge that the object possessed constituted a dangerous weapon.

  • Authorizes an expelled student over the age of 18 or the parent or legal guardian of an expelled student to petition the expelling school board for reinstatement (Sec. 1311).
