Title: SENSE Act

Vote to pass a bill that exempts power plants that convert coal refuse into energy from certain Environmental Protection Agency (EPA) regulations.

Highlights:

 

  • Exempts certain coal-refuse plants from air regulations of the Environmental Protection Agency (EPA) (Sec. 2).

  • Establishes an alternative means for coal-refuse plants to be in compliance with EPA emission standards related to hydrogen chloride and sulfur dioxide (Sec. 2).

  • Defines “coal refuse” as any byproduct of coal mining, physical coal cleaning, or coal preparation (Sec. 2).

  • Specifies that the new exemptions and compliance standards apply to any coal-refuse plant that meets the following criteria (Sec. 2):

    • The plant uses fluidized bed combustion technology to convert coal refuse into energy; and

    • The coal refuse  is at least 75 percent of the annual fuel consumed by heat input.

  • Prohibits the EPA from requiring units to comply with both an emission standard for hydrogen chloride and an emission standard for sulfur dioxide (Sec. 2).
