Title: Limits Nuisance Damages Against Livestock Farmers
Vote to pass a bill that limits the damages that can be received in nuisance suits against operators of animal feeding operations.
Specifies that animal feeding operations which interfere with an individual’s comfortable use and enjoyment of their life or property shall be presumed to be a permanent nuisance, and that damages shall only be awarded as specified in this statute (Sec. 1).
Authorizes compensatory damages due to decrease in fair market value of an individual’s property (Sec. 1).
Authorizes compensatory damages due to a medical condition caused by the nuisance (Sec. 1).
Authorizes compensatory damages due to annoyance or loss of enjoyment of property and specifies that such damages shall not exceed 1 and a half times that combined damages awarded according to the above two provisions (Sec. 1).
Specifies that this statute does not apply to nuisances caused by a violation of federal or state regulation, failure to use best practices, or to operators who have been deemed habitual violators (Sec. 1).
