Title: Prohibits Local Regulations on Plastic Bags
Vote to pass a bill that prohibits local governments from regulating the use of plastic bags or other auxiliary containers by retail or food establishments.
Prohibits local ordinances from regulating or imposing a fee on the use of auxiliary containers by retail, manufacturer, or distribution establishments (Sec. 1).
Specifies that this bill does not prohibit local regulations on solid waste removal or recycling programs (Sec. 1).
Specifies that an auxiliary container includes any bag, cup, bottle, or other packaging that is (Sec. 1):
Designed to be either reusable or single-use;
Made of plastic, cloth, paper, cardboard, polystyrene, aluminum, or glass; and
Used for consuming, transporting, or protecting merchandise, food, or beverages from or at a food service or retail facility.
