Vote to concur with House amendments and pass a bill that authorizes a 6-year extension of the Foreign Intelligence Surveillance Act (FISA).

Highlights:

• Authorizes a 6-year extension of FISA, a federal law authorizing surveillance in order to gain foreign intelligence, effective from January 19, 2018 until December 31, 2023 (Sec. 201).

• Specifies that the reauthorization includes Section 702 of FISA , which allows surveillance without a warrant of a non-U.S. citizen who is located outside of the United States (Sec. 201).

• Requires the Federal Bureau of Investigation (FBI), or any other agency in the intelligence community, to obtain a probable cause-based order from the Foreign Intelligence Surveillance Court (FISC) before collecting surveillance data on a U.S. citizen for any purpose unrelated to national security (Sec. 101).

• Increases the prison term for unauthorized removal or retention of classified information from 1 year to 5 years (Sec. 202).

• Authorizes FISC to compensate an amicus curiae, the latin term for an impartial individual or organization that provides, often voluntarily, intelligence to the court on a particular case (Sec. 106).

• Prohibits reprisal for providing intelligence, including any job demotion or other decision concerning pay, benefits, duties or working conditions (Sec. 110).

• Requires an annual report, to be made public each year, on the number of orders requested for surveillance, the number of orders granted, modified, or denied, and the number of subjects targeted by surveillance (Sec. 107).

• Defines the term "intelligence community" to not only include the FBI, the National Security Agency (NSA), and the Drug Enforcement Administration (DEA), but also any department or agency designated by the president or designated jointly by the Director of National Intelligence and the head of the department or agency concerned (Sec. 204).
