Title: Stop Settlement Slush Funds Act of 2017

Vote to pass a bill that prohibits government officials from entering into or enforcing a settlement agreement on behalf of the United States that provides for a payment or loan to any individual or entity other than the United States.

Highlights:

  • Prohibits an official or agent of the government from entering into or enforcing any settlement agreement on behalf of the United States, that directly providing for loan or payment toward any person or entity other than the United States unless (Sec. 2):

    • The loan or payment provides restitution or directly remedies actual harm caused by the party making the payment.

  • Defines “Settlement Agreement” as a process that resolves the following, including, but not limited to (Sec. 2):

    • A civil or potential civil action;

    • A plea agreement; or

    • A deferred or non-prosecution agreement.

  • Specifies that the head of each federal agency shall submit a report to the Congressional Budget Office on each settlement agreement entered into by that agency during said fiscal year that did the following, including, but not limited to (Sec. 2):

    • Provided restitution or remedied actual harm directly and proximately caused by the party making the loan or payment; or

    • Constituted payment for services offered in connection with the case.

  • Specifies that the general of each federal agency shall submit a report to the Congress on any settlement agreement entered into in violation of this section by that agency (Sec. 2).
