Title: Amends Distracted Driving Penalties

Vote to pass a bill that amends distracted driving penalties by creating an additional fee for moving violations that involve use of a handheld device.

Highlights:

 

  • Authorizes an additional fine of $100 for an individual who commits a driving offense while distracted, and the distracting activity was a contributing factor in causing the offense (Sec. 1).

  • Defines “Distracted” as using a handheld electronic wireless communications device while operating a vehicle or (Sec. 1):

    • Is engaging in any activity that is not necessary for the operation of a vehicle and impairs the ability of the operator to drive the vehicle safely.

  • Exempts the utilization of the following electronic devices while operating a vehicle from this bill, including, but not limited to (Sec. 1):

    • The device’s speakerphone function; or

    • Any device that is physically or electronically integrated into the motor vehicle.

  • Specifies that an offender will still be required to pay the established fine for the driving offense but can elect to attend a distracted driving safety course which upon completion will exempt them from the additional $100 fine (Sec. 1).
