Vote to pass a bill that authorizes deportation of any immigrant suspected of gang membership.

Highlights:

• Authorizes that the Secretary of Homeland Security and the Attorney General will have the power to deport an immigrant who is suspected of gang membership or has participated in the activities of a criminal gang (Sec. 2).

• Specifies that the Secretary of Homeland Security and the Attorney General may designate a group, club, organization, or association of 5 or more individuals as a criminal gang if the Secretary finds their conduct matches the definition given under this act (Sec. 2).

• Defines “criminal gang” as an ongoing club, organization, or association of 5 or more individuals who have the primary purpose of committing 1 or more of the following criminal offenses (Sec. 2):

• A felony drug offense as defined under the Controlled Substances Act;

• The bringing or harboring of undocumented individuals;

• A crime of violence;

• A crime involving obstruction of justice, tampering, retaliation, or burglary; or

• Conduct related to fraud, slavery, or human trafficking.

• Authorizes the Secretary to amend and reclassify a gang designation if found that the group, club, organization, or association of 5 or more individuals has done any of the following, including, but not limited to (Sec. 2):

• Changed their name;

• Adopted a new alias;

• Dissolved and then reconstituted themselves under a different name; or

• Merged with another group, club, organization, or association of 5 or more individuals.

• Prohibits an immigrant from being eligible for parole unless the immigrant has or is assisting the United States Government in a law enforcement matter (Sec. 2).
