Vote to pass a bill that increases the penalties for drug trafficking and drug possession convictions when the drug involved is a fentanyl-related compound.

Highlights:

 

  • Specifies that certain fentanyl-related compounds are now on the statutory controlled substance Schedule I (Sec. 1).

  • Amends the definition of a major drug offense to include possessing or selling at least 1,000 unit doses or 100 grams of a fentanyl-related compound (Sec. 1).

  • Reduces the amount of fentanyl that must be involved in order for an individual to be convicted of “aggravated funding of drug trafficking” (Sec. 1)

  • Requires an additional mandatory prison term of 3 to 8 years for a possession or drug trafficking conviction that involves a fentanyl-related compound (Sec. 1).

  • Specifies that the additional prison term specified above does not apply in the following cases (Sec. 1):

    • The drug involved is a fentanyl-related compound mixed with marijuana or a Schedule III, IV, or V controlled substance;

    • The total amount of the combination of the fentanyl-related compound and the other controlled substance is less than 40 unit doses or is less than 4 grams; and

    • The offender does not know that the combination involved contains a fentanyl-related compound.

  • Amends the manner of determining the sentence for an offense that involves drug abuse (Sec. 1).

  • Specifies that lisdexamfetamine is now on the list of Schedule II controlled substances (Sec. 1).
