Title: Raises Tobacco Sales Age to 21

Vote to concur with House amendments and pass a bill that raises the age limit for purchasing tobacco products to 21.

Highlights:

 

  • Prohibits an individual under 21 years of age from purchasing or attempting to purchase tobacco products of inhalant delivery systems (Sec. 4).

  • Specifies that individuals who knowingly distribute or sell tobacco products or inhalant delivery systems to individuals under the age of 21 are guilty of a civil violation (Sec. 2)

  • Establishes fines for violations of the minimum tobacco sales age in the following amounts (Sec. 2):

    • For an individual who commits such violation, $50;

    • For a manager or supervisor of an individual who commits such violation, $250 for a first or second violation and $500 for a third or subsequent violation; and

    • For an individual who owns a business where such violation is commited, $500 for a first or second violation and $1000 for a third or subsequent violation.

  • Requires individuals who sell tobacco products or inhalant delivery systems to prominently post a sign stating that the sale of tobacco products and inhalant delivery systems to individuals under 21 is prohibited by law (Sec. 3).

  • Requires individuals who sell tobacco products or inhalant delivery systems to request identification from any individual attempting to purchase such products who appears to be under the age of 30 (Sec. 13).

  • Replaces all instances of the phrases “minors” or “persons under 18” with “persons under 21” (Secs. 6-8, 10-14, & 20).

  • Specifies that colleges and universities are included in the state’s smoke free air policy (Sec. 14).
