Title: Promoting Cross Border Energy Infrastructure Act

Vote to pass a bill establishing a modern process for the authorization of pipeline construction.

Highlights:

  • Authorizes that a Presidential Permit is no longer required for the construction, connection, operation, or maintenance of an oil or natural gas pipeline, or electric transmission facility (Sec. 2).

  • Requires that an individual must obtain a certificate of crossing if that individual plans to construct, connect, operate, or maintain a border-crossing facility for the import or export of oil or natural gas across an international border (Sec. 2).

  • Requires that a certificate of crossing shall be issued no later than 120 days following the final action taken by the relevant official or agency unless (Sec. 2):

    • The official or agency finds the construction, connection, operation, or maintenance of the border-crossing facility is not in the public interest of the United States.

  • Specifies that no existing oil or natural gas pipeline, or operating electric transmission facility will be required to obtain a certificate of crossing (Sec. 2).

  • Defines “border-crossing facility” as the portion of an oil or natural gas pipeline or electric transmission facility that is located at an international boundary of the United States (Sec. 2).
