Title: No Sanctuary for Criminals Act

Vote to pass a bill that prohibits disbursement of federal grants to jurisdictions with "sanctuary city" policies.

Highlights:

  • Prohibits the disbursement of federal funds for a minimum of 1 year to any state found not to be in compliance with the provisions of this bill (Sec. 2).

  • Authorizes the Secretary of Homeland Security to withhold the transfer of any undocumented immigrant in the custody of the Department of Homeland Security to any state or political subdivision found not to be in compliance with the provisions of this bill (Sec. 2).

  • Authorizes local law enforcement officials to detain an individual found in violation of any criminal or motor vehicle law in order for the Secretary to issue a detainer regarding the individual if there is probable cause to believe that the individual is an undocumented immigrant (Sec. 3).

  • Specifies that probable cause for issuing a detainer is established if (Sec. 3):

    • The individual matches biometric or Federal database records the identity of an undocumented immigrant;

    • The individual who is the subject of the detainer is already the subject of ongoing removal proceedings;

    • The individual who is the subject of the detainer has made voluntary statements or provided reliable evidence that indicate they are an undocumented immigrant; or

    • The Secretary  otherwise has reasonable grounds to believe that the individual who is the subject of the detainer is an undocumented immigrant.

  • Defines the statute of limitations for the issuance of a detainer as 10 years following the occurrence of the crime or incident (Sec. 3).

  • Specifies that there is no bonding out or time limitations for the detainment and holding of an individual suspected of being an undocumented immigrant (Sec. 4).
