Title: Establishes Prescription Drug Monitoring Program

Vote to pass with amendment a bill that establishes a prescription drug monitoring system.

Highlights:

 

  • Requires the Department of Health and Human Services to establish and maintain a program for monitoring the prescription and dispensing of all Schedule II, III, and IV controlled substances (Sec. 1).

  • Requires each prescription drug dispenser to electronically report information regarding Schedule II, III, and IV controlled substances (Sec. 2).

  • Establishes that the data collected by the Department will include but not be limited to (Sec. 2):

    • The quantity and dosage of the drug dispensed;

    • The patient’s driver’s license number;

    • The date of dispensation and;

    • The patient’s insurance information.

  • Requires dispensers to submit the required information to the state within 24 hours of dispensation (Sec. 3).

  • Authorizes the Department to issue waivers to dispensers unable to submit dispensation information by electronic means (Sec. 4).

  • Authorizes exceptions to this law in the event of a medical emergency, if a patient is terminally ill, or it is not possible to use the program (Sec. 5).

  • Authorizes the Department to provide data collected from the program to individuals requesting their own information, persons authorized to prescribe or dispense controlled substances, law enforcement, and the State Board of Pharmacy (Sec. 5).

  • Prohibits the information in the Department database from preventing an individual from owning or obtaining a firearm (Sec. 7).

  • Prohibits the information in the Department database from being used as evidence to grant a search warrant to an individual’s property (Sec. 8).

  • Specifies that any individual who unlawfully and knowingly accesses or discloses information from the Department database to unauthorized individuals is guilty of a class E felony (Sec. 8).

  • Requires dispensers to begin to phase in the ability to report prescribing data in real time (Sec. 2).

  • Requires all prescribing data to be reported in real time by 2020 (Sec. 2).
