Title: Authorizes the Sale of Consumer Fireworks
Vote to pass a bill that authorizes the sale of consumer fireworks.
Requires the fire marshal to establish minimum requirements for the issuance of a consumer fireworks seller’s license for retailers or community groups (Sec. 3).
Establishes a $1,000 annual fee for every retailer who devotes more than 50% of a permanent building to the sale of class 1 fireworks and a $500 fee for every retailer who devotes less than 50% of their sales floor to class 1 fireworks (Sec. 3).
Requires all retailers or community groups selling fireworks to comply with the American Pyrotechnics Association National Fire Protection Standards (Sec. 3).
Authorizes fireworks to be sold at permanent buildings between June 1 and July 8 every year, and at temporary structures between June 13 and July 8 of every year (Sec. 3).
Prohibits the sale of consumer fireworks to anyone under the age of 18 (Sec. 3).
Establishes the Consumer Fireworks Fee Fund to financially support the fire marshal’s duties in enforcing consumer fireworks regulations (Sec. 3).
Requires the state fire marshal to establish a grant for local fire protection and emergency medical services to provide the public with fireworks safety education (Sec. 3).
Specifies that violators of this bill are guilty of a simple misdemeanor (Sec. 3).
Requires all fireworks wholesalers to register with the state fire marshal annually and pay a fee of $1,000 (Sec. 4).
Authorizes city councils to prohibit the sale of consumer fireworks by resolution or ordinance (Sec. 8).
Prohibits the use of consumer fireworks in state parks and preserves except as authorized by a permit (Sec. 9).
Specifies that individuals who set off display fireworks, which contain explosive substances, have committed a simple misdemeanor and are subject to a fine of no less than $250 (Sec. 10).
