Title: Strengthens Privacy of Internet Users

Vote to pass a bill that establishes security regulations for internet service providers regarding customer proprietary information, effective December 31, 2018.

Highlights:

 

  • Prohibits internet service providers from selling or transferring customer data without the customer’s consent (Sec. 2).

  • Prohibits internet service providers from displaying or sending advertisements chosen because of a customer’s data without the customer’s consent (Sec. 2).

  • Specifies that this bill applies to a customer’s call history, finances, health, household composition, location, web browsing history, application usage, social security numbers and other personally identifiable information (Sec. 1).

  • Requires internet providers to obtain approval at the time of sale and obtain new approval if changes in actions are inconsistent with the original terms or conditions (Sec. 2).

  • Requires internet providers to provide a mechanism to grant, deny, or withdraw approval for any actions taken with customer information (Sec. 2 & 3).

  • Specifies that these regulations do not apply to customer proprietary information that is sold as part of a merger or other such transfer of company assets (Sec. 2).

  • Prohibits providers from conditioning or terminating service based on a customer’s agreement to waive privacy rights (Sec. 3).

  • Requires internet providers that offer financial incentive for information to provide terms and conditions for the use of that information (Sec. 3).

  • Specifies that the utilities and transportation commission will enforce the provisions of this bill (Sec. 5).

  • Authorizes the utilities and transportation commission to expire this bill if the federal government establishes similar guidelines (Sec. 7).
