Title: Reduces Penalties for Marijuana Possession
Vote to pass a bill with an amendment that reduces the penalty for possession of marijuana.
Reduces the penalty for possessing 3 quarters of an ounce of marijuana or 5 grams of hashish to the following (Sec. 2):
A violation for individuals at least 21 years of age;
A misdemeanor for individuals between the ages of 18 and 21; and
A delinquency petition for individuals under the age of 18.
Establishes the following possession penalties for individuals at least 18 years of age (Sec. 2):
$100 fine for 1st and 2nd offenses;
A fine of up to $300 for any subsequent offense within any 3-year period; and
A Class B misdemeanor for any 4th offense within a 3-year period.
Authorizes the court to waive the fine for a single conviction within a 3-year period upon proof that the person has completed a substance abuse assessment by a licensed drug and alcohol counselor within 60 days of the conviction (Sec. 2).
Prohibits public access to records that include identifiable information pertaining to an individual convicted for possession (Sec. 2).
