Vote to pass a bill with an amendment that reduces the penalty for possession of marijuana.

Highlights:

 

  • Reduces the penalty for possessing 3 quarters of an ounce of marijuana or 5 grams of hashish to the following (Sec. 2):

    • A violation for individuals at least 21 years of age;

    • A misdemeanor for individuals between the ages of 18 and 21; and

    • A delinquency petition for individuals under the age of 18.

  • Establishes the following possession penalties for individuals at least 18 years of age (Sec. 2):

    • $100 fine for 1st and 2nd offenses;

    • A fine of up to $300 for any subsequent offense within any 3-year period; and

    • A Class B misdemeanor for any 4th offense within a 3-year period.

  • Authorizes the court to waive the fine for a single conviction within a 3-year period upon proof that the person has completed a substance abuse assessment by a licensed drug and alcohol counselor within 60 days of the conviction (Sec. 2).

  • Prohibits public access to records that include identifiable information pertaining to an individual convicted for possession (Sec. 2).
