Highlights:

  • Prohibits city and county governments from imposing fees or enforcing ordinances or laws which prohibit or have the practical effect of prohibiting residential dwelling rentals (Sec. A).

  • Authorizes city and county governments to enact and enforce ordinances or laws that, in order to protect the public’s health and safety, impose reasonable regulations on residential dwelling rentals relating to requirements and restrictions including but not limited to (Sec. A):

    • Sanitation, pollution control, fire and building codes, and parking restrictions;

    • Registration, permit, inspection, or self-inspection requirements;

    • Response time periods for nuisance complaints;

    • Minimum age requirements for renters; and

    • Limiting or prohibiting rentals to sexual offenders.

  • Prohibits city and county governments from requiring periodic interior inspections of privately owned residential property unless such inspection is consented to by the owner (Sec. A).

  • Specifies that renters shall pay and owners shall collect and pay any applicable taxes imposed by the state or local government on guests for the occupancy of a residential dwelling rental (Sec. A).

  • Requires such taxes to be collected and paid as follows (Sec. A):

    • If an owner uses a facilitation platform, such platform shall collect and pay taxes on behalf of the owner; and  

    • If the owner uses a marketing platform, the owner shall collect and pay taxes.  

  • Prohibits city and county governments from requiring owners to obtain a business or occupation license in order to rent or lease property for no more than 182 days in a calendar year (Sec. A).
