Title: Prohibits Donation of Fetal Tissue

Vote Smart's Synopsis:

A vote to pass a bill that prohibits the donation of fetal tissue obtained from an abortion.

Highlights:

 

  • Prohibits individuals from knowingly donating or making anatomical gifts to any person or entity for purposes including but not limited to medical, scientific, experimental, or therapeutic use (Sec. A).

  • Requires the patient to be informed of the process for disposing of fetal tissue and remains after an abortion (Sec. A).

  • Requires the consenting parent or guardian of a minor to provide written notice to any other custodial parent, except in certain cases including but not limited to (Sec. A):

    • Cases in which such custodial  parent has been convicted of a sexual crime in which a child was a victim;

    • Cases in which such custodial parent is listed on the sexual offender registry;

    • Cases in which such parent’s custodial, parental, or guardianship rights have been terminated by a court; or

    • Cases of emergency.

  • Requires the Department of Health and Senior Services to conduct unannounced, onsite inspections of ambulatory surgery centers that perform or induce abortions (Sec. A).

  • Requires all tissue removed in an abortion be sent to a pathologist, who will compile and file a tissue report, which will include information including but not limited to (Sec. A):

    • A unique identification number for the remains to allow the specimen to be tracked from the abortion facility to its final location; and

    • Certification of the disposal of the remains in accordance with state laws and regulations.

  • Establishes that any individual in violation of this act is guilty of a class C felony and subject to a fine of no less than twice the value of the consideration received (Sec. A).
