Title: Prohibits the Use of Victim's Past Sexual Activity as Evidence in Sexual Assault Cases
Vote to pass a bill to prevent a sexual assault victim's past sexual activity from being used as evidence in court, effective 60 days after its passage.
Prohibits the use of proffered evidence, such as the sexual activity of the victim, from being used in the testimony of sexual assault cases (Sec. 1).
Defines “sexual activity” as any conduct or behavior relating to the sexual activity of the victim including but not limited to previous or subsequent experiences of (Sec. 1):
Sexual penetration or sexual contact;
Sexual predisposition;
Thoughts or expressions related to sexual issues;
Use of contraceptives;
Sexual activities reflected in medical and counseling records;
Living arrangements; and
Lifestyle.
