Title: Establishes a Statewide Sanctuary Policy
Vote to concur with Assembly amendments and pass a bill which establishes a statewide immigration sanctuary policy.
Prohibits state law enforcement agencies from engaging in behaviors including, but not limited to, the following (Sec. 3):
Inquiring into an individual's immigration status;
Detaining an individual on the basis of a hold request;
Providing personal information about an individual, such as a home address; and
Making arrests based on civil immigration warrants.
Specifies that responses to requests for information regarding an individual’s release date are permitted, but not required, if there are submitted in accordance with Section 2 of this act (Sec. 3).
Authorizes law enforcement officers to transfer an individual to immigration authorities only if authorized by a judicial warrant or in accordance with Section 2 of this act (Sec. 3).
Specifies that law enforcement officers shall have the discretion to cooperate with immigration authorities if such cooperation does not violate any federal, state, or local laws and establishes a list of circumstances in which cooperation with immigration authorities is permitted (Sec. 2).
Prohibits state law enforcement from placing peace officers under federal supervision or employing peace officers who are deputized as special federal officers for the purposes of immigration enforcement (Sec. 3).
Specifies that the provisions of this bill do not limit state law enforcement cooperation with federal law enforcement in responding to requests regarding an individual’s criminal record, notification of release date when an individual has previously been convicted of a violent felony, or in situations in which an individual may be a victim of human trafficking (Sec. 3).
