  • Specifies that if an individual is found guilty of sexual intercourse without consent and is 18 years old or younger, in cases where the victim is at least 14 years of age, the offender is to be punished by imprisonment in state prison for no more than 5 years with a fine not more than $10,000 if (Sec. 1):

    • The offender has not previously committed or been adjudicated for a sexual offense;

    • Psychosexual evaluation of the offender is prepared and the court finds registration is not necessary for protection of the public’s best interest; and

    • The court finds the alleged conduct was consensual as indicated by words or overt actions indicating freely given agreement to have sexual intercourse.
