Title: Limits Collective Bargaining for Public Employees

Vote to pass a bill that limits collective bargaining for public employees, among other provisions.

Highlights:

  • Requires public employers to offer health insurance to all permanent, full-time public employees (Sec. 65).
  • Prohibits bargaining units without 30 percent of members who are public safety employees from including the following issues in contract negotiations (Sec. 6):
    • Insurance;
    • Leaves of absence for political activities;
    • Supplemental pay;
    • Transfer procedures;
    • Evaluation procedures;
    • Procedures for staff reduction; and
    • Subcontracting of public services.
  • Authorizes city councils to extinguish seniority rights of all civil service employees who are not firefighters, police officers, fire chiefs, or police chiefs (Sec. 55).
  • Requires arbitration involving a unit without at least 30 percent of members who are public safety employees to consider the following factors (Sec. 13):
    • Comparison of base wages, hours, and conditions of employment with other public employees doing comparable work;
    • The interests and welfare of the public; and
    • The financial ability of the employer to meet the cost of an offer with current economic conditions.
  • Prohibits arbitration involving a unit without at least 30 percent of members who are public safety employees from considering past collective bargaining agreements and the public employer’s possible ability to fund an award through the increase or imposition of new taxes, fees, or charges (Sec. 13).  
  • Defines public safety employee as any of the following (Sec. 1):
    • A sheriff’s regular deputy;
    • A marshal or police officer who is a member of a paid police department;
    • A member, except a non-peace officer member, of the state patrol, narcotics enforcement, the state fire marshal, or a criminal investigation;
    • A conservation officer or park ranger;
    • A permanent or full-time firefighter who is member of a paid fire department; or
    • A peace officer subject to mandated law enforcement training.
